At Disability Experts Of Florida, we are a Florida Social Security disability advocacy group and are paid 25 percent of the retroactive dollar amount of a Social Security Disability Insurance (SSDI) benefits award. The Social Security Administration (SSA) sets this rate. The longer you must wait, the greater the retroactive benefits are. In this case, both the claimant and the advocate, DEF, are paid more. Currently, the maximum fee under the standard Fee Agreement process is capped at $6,000 and the maximum fee would only apply in situations where the applicant was awarded at least $24,000 in retroactive benefits.
What is the Retroactive Award for Florida Social Security Benefits?
If either your application or appeal is approved, the SSA will pay a monthly cash benefit. The SSA also pays you for the period of time it takes to approve your application (subject to the date on which you are found to be disabled). This is the retroactive, or back pay, portion of your Florida Social Security benefits. This retroactive benefit is a one-time-only lump sum and is calculated based on your waiting period, fling date and disability date. Your entitlement date is set after a waiting period of five full months after SSA determines the date of your disability.
